Trust Registration Process in India

According to the Indian Trust Act, the below-mentioned criteria must be followed before registering a Trust in India:

The steps to be followed for trust registration are:

• Draft the Trust Deed.
• Choose an appropriate name for the NGO.
• Determine 2 trustees and decide on the beneficiary.

• Address proofs of trustees and settlers which includes documents like driving license, passport, etc.
• Electricity, house tax, water bill or ownership proof of the property.
• If the trust will be established on a rented property, rent deed or agreement is an essential requirement and along with it NOC from the landlord on a stamp paper, name of the landlord, father’s name, address must also be submitted.
• The physical presence of settlers and two witnesses are necessary with original ID proofs at the time of registration.

• Select a name for the NGO. The proposed named must be filed for reservation through the Reserve Unique Name facility available on the MCA website.
• Preparation of the MOA and AOA of the organization along with some essential documents like the Profit and loss statement, statement of assets and liabilities, description of work, etc.
• Filing an incorporation application in the SPICe Form along with the required documents.
• After proper verification of the application Certificate of Incorporation along with the license will be issued.

PAN and ID proofs which include Passport, driving license, Voter ID) of all the promoters/directors
